Conditions governing use of the CyberMotion AI website and general service relationship.
Effective date: 10 July 2026
1. Agreement
These Terms of Service ("Terms") govern your access to cybermotionai.pro and general conditions applicable before a separate Master Services Agreement is executed. By using this website, you agree to these Terms. If you do not agree, discontinue use immediately.
CyberMotion AI Inc., located at 95 King Street East, Suite 205, Toronto, ON M5C 1G4, provides defensive cybersecurity services to business clients. Website content is informational and does not itself create a client relationship.
2. Website use
You may browse our website for lawful purposes. You must not:
- Attempt unauthorised access to our systems or third-party systems through our site
- Introduce malware, scraping bots, or automated tools that impair site performance
- Reproduce substantial portions of content without written permission
- Misrepresent affiliation with CyberMotion AI
- Submit false or defamatory information through our contact form
We may suspend access to protect site integrity or investigate suspected abuse.
3. Services and engagements
Cybersecurity services are delivered under written statements of work or master agreements that supersede these Terms where they conflict. Proposals, slide decks, and email discussions are non-binding until a contract is signed by authorised representatives of both parties.
Service descriptions on this website are summaries. Specific deliverables, timelines, service levels, and fees appear only in executed contracts.
4. Intellectual property
All website content, trademarks, and branding are owned by CyberMotion AI Inc.. Client engagements address ownership of custom detection rules, models, and reports in contract documents. Unless otherwise agreed, client-owned telemetry remains client property; CyberMotion AI retains rights to general methodologies and pre-existing tools.
5. Confidentiality
Information shared during sales discussions is treated as confidential if marked or reasonably understood as sensitive. Formal mutual NDAs are available on request. Public information, independently developed knowledge, and lawfully obtained third-party information are excluded.
6. Disclaimers
Website content is provided "as is" without warranties of any kind. We do not warrant uninterrupted site availability or error-free materials. Cybersecurity outcomes depend on client cooperation, environment complexity, and adversary behaviour. We do not guarantee prevention of all security incidents.
7. Limitation of liability
To the maximum extent permitted by Ontario law, CyberMotion AI Inc. shall not be liable for indirect, incidental, special, or consequential damages arising from website use. Aggregate liability for website-related claims shall not exceed one hundred Canadian dollars. Nothing in these Terms limits liability for fraud, gross negligence, or personal injury where limitation is prohibited by law.
Contracted service liability is governed by applicable service agreements, which typically include mutually negotiated caps and exclusions.
8. Indemnity
You agree to indemnify CyberMotion AI Inc. against claims arising from your misuse of the website, violation of these Terms, or infringement of third-party rights through content you submit.
9. Third-party links
Our site may link to external resources. We do not control and are not responsible for third-party content or privacy practices. Access linked sites at your own discretion.
10. Privacy and cookies
Personal information handling is described in our Privacy Policy. Cookie usage is described in our Cookie Policy. Both form part of these Terms by reference.
11. Governing law and disputes
These Terms are governed by the laws of Ontario and applicable federal Canadian law. Parties attorn to the exclusive jurisdiction of courts in Toronto, Ontario. Before litigation, parties agree to attempt good-faith resolution by escalating to designated contacts within fifteen business days of written notice.
12. Changes
We may revise these Terms by posting an updated version with a new effective date. Material changes affecting ongoing website users will be highlighted on this page for at least thirty days.

14. Force majeure
Neither party shall be liable for delays or failures resulting from events beyond reasonable control, including natural disasters, widespread internet outages, government actions, or labour disputes affecting critical suppliers. The affected party must notify the other promptly and resume performance as soon as practicable. If force majeure continues beyond sixty days, either party may terminate affected service components upon written notice without penalty except for work already performed.
15. Assignment
You may not assign rights or obligations under these Terms without our written consent. We may assign to an affiliate or successor in connection with a merger, acquisition, or corporate reorganisation provided the assignee assumes obligations substantially similar to those herein. Notice of assignment will be posted on this page where material to website users.
16. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving original intent, or severed if modification is not possible.
17. Entire agreement for website use
These Terms, together with the Privacy Policy and Cookie Policy incorporated by reference, constitute the entire agreement regarding website use. They supersede prior oral or written understandings on that limited subject. Contracted cybersecurity services remain governed by separate executed agreements that prevail over these Terms where conflicts arise.
18. Language
These Terms are drafted in English, which is the controlling language. Any French translation provided for convenience shall not alter interpretation of the English version in the event of discrepancy, except where Quebec consumer protection law requires otherwise.
19. Survival
Provisions that by their nature should survive termination, including intellectual property, confidentiality, disclaimers, limitation of liability, indemnity, and governing law, shall survive cessation of website use or expiration of any related trial engagement.
20. Waiver
Failure to enforce any provision of these Terms at any time does not constitute a waiver of that provision or any other provision. Waivers must be in writing signed by an authorised representative of CyberMotion AI Inc..
21. Notices
Formal notices regarding these Terms may be delivered by email to [email protected] or by registered mail to 95 King Street East, Suite 205, Toronto, ON M5C 1G4. Notices are deemed received on the business day following transmission for email and five business days after posting for mail within Canada.
22. Electronic communications
By using this website and providing your email address, you consent to receive communications electronically. You agree that electronic records satisfy any legal requirement that communications be in writing, subject to mandatory non-waivable consumer rights under applicable provincial law.
23. Export compliance
You represent that you are not located in a jurisdiction subject to comprehensive Canadian trade sanctions and that you will not use our website or services to export technical data or services in violation of applicable export control laws. We reserve the right to decline or terminate engagements where compliance risk cannot be mitigated.
24. Feedback
Suggestions or feedback you provide about our website or services may be used by CyberMotion AI Inc. without obligation or compensation, except where a separate written agreement states otherwise. Do not submit confidential information through unsolicited feedback channels.
25. Headings
Section headings in these Terms are for convenience only and do not affect interpretation. References to statutes include amendments and successor legislation. Words importing the singular include the plural and vice versa where context requires.
